License Agreement

This End-User License Agreement ("EULA") is a legal agreement between you (the "Licensee") and Kick Forge Audio, operated by Sven Kniest Music Productions (the "Licensor").

By downloading any audio samples, kicks, presets, or digital materials (collectively the "Sounds") from kickforgeaudio.com, you agree to be bound by the terms of this License Agreement.

1. Grant of License

Upon purchasing a subscription or downloading our Free Pack, Kick Forge Audio grants you a non-exclusive, non-transferable, and perpetual license to use the Sounds worldwide, strictly in accordance with the terms below.

This means you have the right to use the Sounds in your music, but you do not "own" the raw, isolated audio files.

2. Permitted Uses (Royalty-Free)

All official Sounds provided by the Kick Forge Audio Core Library and Drops are 100% Royalty-Free. You are fully authorized to use the Sounds in combination with other sounds in music productions (which include soundtracks, films, radio/TV commercials, video games, and live performances).

  • You may release tracks containing our Sounds on commercial platforms like Spotify, Apple Music, Beatport, YouTube, and SoundCloud.
  • You may submit tracks containing our Sounds to record labels.
  • You are not required to pay any additional royalties, clearance fees, or give specific credit to Kick Forge Audio for the use of the Sounds in your compositions.

3. Prohibited Uses

To protect our intellectual property and the value of our library, the following actions are strictly prohibited and will result in immediate termination of your license and account:

  • Reselling / Redistribution: You may not sell, rent, lease, sub-license, or share the raw, isolated Sounds. You cannot upload our kicks to sample-sharing websites (like Splice, Looperman, etc.).
  • Competitive Products: You may not use the Sounds to create competitive products, such as incorporating them into your own sample packs, synthesizer presets, or construction kits.
  • Account Sharing: This license is granted to a single user (you). You may not share the downloaded Sounds or your account login details with other producers.
  • AI Training: You may not use the Sounds, in whole or in part, to train artificial intelligence (AI) models or machine learning audio generation tools.

4. Community Presets & User-Generated Audio

The Kick Forge Studio allows users to share custom presets that may contain their own uploaded audio samples ("Community Presets"). When you download and use a Community Preset created by another user, the following specific rules apply:

  • Usage Rights: You are granted the same license to use the resulting kick in your own musical compositions, subject to the same Prohibited Uses outlined in Section 3.
  • Disclaimer of Warranty (Use at Your Own Risk): Because Community Presets contain audio uploaded by third-party users, Kick Forge Audio cannot verify or guarantee that the uploader holds the proper copyright clearances. You download and use Community Presets entirely at your own risk.
  • Liability for Infringement: Kick Forge Audio explicitly disclaims any liability for copyright infringement claims arising from your use of a Community Preset. If a takedown notice is issued regarding a specific community sound, we will remove it from the platform, and you may be required by the rights holder to cease using that sound in your productions.

5. Kick Forge Elite (Custom Kicks)

If you are an Elite subscriber receiving a Custom Kick tailored to your specifications, a special 100% Exclusive License applies:

  • Complete Exclusivity: Your Custom Kick is forged uniquely for you. We guarantee it will never be added to the Kick Forge Pro library or sold to any other producer.
  • Usage Rights: You are granted an exclusive, perpetual, worldwide, and royalty-free license to use the Custom Kick in any commercial or non-commercial musical compositions.
  • Master Ownership (Anti-Resale Protection): To protect our sound design methods, Kick Forge Audio retains the master copyright of the raw audio file. This simply means you have the ultimate freedom to use the kick in your tracks, but you are not allowed to resell, redistribute, or upload the naked, isolated kick as part of your own sample pack.

6. Termination

This license is effective until terminated. Your license to use the Sounds will terminate automatically and without notice if you fail to comply with any part of this Agreement. Upon termination, you must stop all use of the Sounds and destroy all copies of the raw audio files in your possession.
