Terms of Service

Welcome to Kick Forge Audio. These Terms of Service ("Terms") govern your access to and use of the kickforgeaudio.com website and its associated services, subscriptions, and digital products (collectively, the "Service").

Kick Forge Audio is operated under the registered business Sven Kniest Music Productions, registered with the Dutch Chamber of Commerce (KvK).

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Accounts and Registration

To access our sample packs and subscriptions, you must create an account. By creating an account, you agree to the following conditions:

• Age Requirement: You must be at least 18 years of age to create an account, or have explicit permission from a parent or legal guardian.
• Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
• Account Sharing Prohibited: Your account is for your personal use only. Sharing your login details with other producers, friends, or third parties is strictly prohibited. Violation of this rule will result in an immediate and permanent ban from the Service without a refund.

2. Subscriptions and Billing

Kick Forge Audio offers digital sample subscriptions ("Kick Forge Pro" and "Kick Forge Elite").

• Billing: Subscriptions are billed on a recurring, periodic basis (monthly or annually). You will be billed in advance on a recurring schedule based on the plan you select.
• Cancellations: You can cancel your subscription at any time through your account dashboard. Your subscription will remain active until the end of your current billing cycle (month or year).
• Price Changes: We reserve the right to modify our subscription prices. Any price changes will be communicated to you in advance and will only apply to future billing cycles.

3. Content Access (Drops & The Vault)

Your subscription grants you specific access to our digital audio libraries based on our "Drop & Vault" system:

• Core Library & New Drops: Active subscribers have continuous access to our Core Kick Library and all new monthly sample pack drops released during their active billing cycle.
• The Vault (Archived Packs): Packs released prior to your subscription start date, or drops that have expired from the current rotation, are securely stored in "The Vault." Upon your initial signup, you will be granted access to select and download exactly two (2) packs of your choice from The Vault. Additional access to The Vault is restricted and may only be granted during special promotional events at our sole discretion.

4. Kick Forge Elite - Custom Kicks

If you are subscribed to the "Kick Forge Elite" tier, you are entitled to request one (1) custom-designed kick per billing month.

• Revisions: Custom kicks include a maximum of two (2) revision rounds based on your feedback.
• No Rollover: Custom kicks do not roll over to the next month. If you fail to submit your custom kick request before the end of your current billing cycle, that month's request expires permanently.

5. Kick Forge Studio

Subscribers gain access to the Kick Forge Studio, our web-based audio application that allows you to design custom kicks by adjusting various layers (punch, tail, tok, kick enhancer) using our Core Library samples.

• Usage & Licensing: Custom kicks generated and downloaded via the Kick Forge Studio are 100% Royalty-Free for use in your own original musical compositions. However, reselling, re-packaging, or redistributing these generated kicks as raw audio files or as part of any sample pack is strictly prohibited.
• Custom Sample Uploads & Community Sharing: You have the option to upload your own audio samples and share your resulting presets with the Kick Forge community. By uploading and sharing any audio file, you guarantee that you own 100% of the rights to that audio, or have explicit legal clearance to use and distribute it. Uploading rips from other sample packs or copyrighted tracks without permission is strictly prohibited.

6. User-Generated Content & Indemnification

When you share a preset containing your own uploaded samples to our public community database, you grant Kick Forge Audio a non-exclusive, worldwide, royalty-free license to host, display, and make that preset (including the associated audio files) available to other users of the Service.

• User Responsibility: You are solely responsible for the content you upload. As a hosting provider, we do not pre-screen or proactively monitor user-uploaded audio files.
• Indemnification: You agree to fully indemnify, defend, and hold harmless Kick Forge Audio (Sven Kniest Music Productions) against any and all claims, damages, financial losses, liabilities, or legal fees arising from third-party copyright infringement claims related to audio files you have uploaded or shared on our platform.

7. Copyright Policy (Notice & Takedown)

Kick Forge Audio respects intellectual property rights and complies with applicable laws, including the Digital Services Act (DSA), regarding user-uploaded content. We operate a strict "Notice and Takedown" procedure.

• Reporting Infringement: If you are a copyright owner (e.g., a sample pack creator or artist) and believe a user has uploaded your protected work to our community without authorization, please contact us immediately at copyright@kickforgeaudio.com. Include proof of ownership and a link to the infringing preset/audio.
• Prompt Removal: Upon receiving a valid and verifiable infringement notice, we will act promptly to remove or disable access to the infringing material.
• Repeat Infringers: Users who upload copyrighted material belonging to others will face immediate removal of their content and a permanent account ban without refund.

8. Digital Delivery and Usage License

All products delivered by Kick Forge Audio are digital audio files.

• Delivery: Files are delivered instantly upon purchase or subscription activation via direct download.
• Licensing: All kicks and samples are provided 100% Royalty-Free for use in your own original musical compositions.
• Restrictions: You may not resell, re-package, or redistribute the raw, isolated audio files as your own sample pack, nor upload them to other sample sharing platforms. (For full details, please refer to our separate License Agreement).

9. Refund Policy

Due to the nature of digital audio products, which cannot be "returned," all sales and subscription payments are strictly final.

Once a sample pack or a custom kick has been downloaded or accessed through our portal, absolutely no refunds will be issued under any circumstances. By downloading the content, you waive your right to a cooling-off period.

10. Intellectual Property

The Service and its original content (excluding the Royalty-Free samples you download or user-generated content, which are licensed separately), features, and functionality are and will remain the exclusive property of Sven Kniest Music Productions and its licensors. The Kick Forge Audio branding, logos, and website design are protected by copyright and trademark laws.

11. Limitation of Liability

In no event shall Kick Forge Audio, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions. Any disputes arising from these terms will be handled exclusively in the courts of The Netherlands.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
